The Guiding Principles of the General Data Protection Rules. The importance of proactively documenting compliance.

This brief paper was drafted having in mind that the new European rules for personal data protection have recently entered into force, on 25 May 2018. As such, this paper is intended to clarify the guiding principles of the General Data Protection Rules (GDPR), including on what touches the legality of both processing personal information and consent. Furthermore, this paper also foresees the intention of the GDPR in creating a proactive culture of data protection among institutions in the private sector, by implementing a set of rules which have prescribed the reverse burden (onus) of proof.
